AGREEMENT TO TERMS These Terms of Use are a legally binding agreement between you, whether personally or on behalf of an entity (“you”), and ISS Horizon / CommandNet (“ISS Horizon,” “CommandNet,” “we,” “us,” or “our”), concerning your access to and use of https://isshorizon.com and any related pages, dashboards, story archives, posts, communications, prototypes, or online services that link to these Terms (collectively, the “Site”). By accessing or using the Site, you agree that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree with these Terms, you must stop using the Site. We may update these Terms from time to time. We will indicate the updated date at the top of this page. Your continued use of the Site after revised Terms are posted means you accept the updated Terms. The Site is intended for users who are at least 13 years old. If you are under 18, you may use the Site only with permission and supervision from a parent or legal guardian. Do not use the Site or submit any personal information if you are under 13 years old. 2. DESCRIPTION OF THE SERVICE ISS Horizon / CommandNet is a fictional sci-fi simulation and story universe. The Site may include public pages, story previews, generated episodes, monthly arcs, captain’s logs, crew files, fictional lore, simulation dashboards, development notes, images, supporter updates, and prototype access. CommandNet is a live prototype in active development. Features may be incomplete, experimental, changed, paused, removed, interrupted, or reorganized at any time. ISS Horizon is a work of fiction. Characters, events, factions, civilizations, organizations, locations, technologies, logs, missions, and story content are fictional unless clearly stated otherwise. 3. PROTOTYPE AND DEVELOPMENT DISCLAIMER ISS Horizon / CommandNet is currently a developing project. We may test new features, change the dashboard, revise story presentation, pause simulation progression, manually advance the simulation, change release schedules, revise archives, correct generated content, or remove content. Any public roadmap, future feature description, Patreon tier description, development note, or project plan is an estimate and not a guarantee. We do not guarantee that any specific feature, schedule, story system, archive, dashboard page, automation, episode cadence, or supporter benefit will remain available permanently. 4. INTELLECTUAL PROPERTY RIGHTS Unless otherwise stated, the Site and all content on or generated for the Site are owned by us or licensed to us. This includes, but is not limited to: - ISS Horizon / CommandNet names and branding - website design and interface elements - source code and software - simulation structure and systems - databases and world-state structures - characters, factions, civilizations, ships, locations, lore, timelines, events, episodes, captain’s logs, monthly arcs, crew profiles, story summaries, images, graphics, and related materials - text, artwork, screenshots, layouts, and story archives The Site and its content are provided for your personal, non-commercial use only. Except as expressly permitted by us in writing, you may not copy, reproduce, scrape, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, modify, create derivative works from, or commercially exploit any part of the Site or its content. You may share ordinary links to public pages of the Site, including public posts, previews, and story pages, as long as you do not misrepresent ownership, remove attribution, or imply endorsement. 5. ACCOUNTS, ACCESS, AND SUPPORTER BENEFITS Some parts of the Site or CommandNet prototype may require access permission, password access, Patreon support, or another form of member access. If accounts or access credentials are provided, you are responsible for keeping your login information confidential. You are responsible for activity that occurs through your account or access credentials. We may modify, suspend, revoke, or discontinue access to any part of the Site at any time, including supporter-only or prototype areas. Patreon memberships, payments, cancellations, refunds, and billing are handled through Patreon and are also subject to Patreon’s terms and policies. Supporting ISS Horizon through Patreon does not give you ownership of the project, the simulation, the story world, the characters, the code, the interface, or any project content. Supporter benefits may change as the project develops. Patreon support helps fund development, but it does not guarantee permanent access, a fixed publishing schedule, a specific feature, a specific story outcome, or control over canon. 6. SUPPORTER FEEDBACK, IDEAS, AND SUBMISSIONS You may choose to send us comments, ideas, suggestions, feature requests, poll responses, names, story-world suggestions, lore ideas, feedback, bug reports, or other materials (“Submissions”). By sending Submissions to us, you agree that: - your Submissions are voluntary - your Submissions are not confidential - you have the right to submit them - we may use, adapt, modify, ignore, publish, develop, or incorporate them into the project without compensation or obligation to you - submitting feedback does not give you ownership, authorship, approval rights, canon control, or any other rights in ISS Horizon / CommandNet We appreciate supporter feedback, but we are not required to implement any suggestion or explain why a suggestion is or is not used. 7. USER CONDUCT AND PROHIBITED ACTIVITIES You agree not to use the Site for any unlawful, harmful, abusive, or unauthorized purpose. You agree not to: - scrape, harvest, copy, archive, or systematically retrieve Site content to create a database, mirror, dataset, competing product, or derivative service - use bots, spiders, scrapers, automated tools, or data-mining systems to access, copy, or extract content from the Site, except ordinary search-engine indexing - attempt to bypass access controls, passwords, paywalls, security features, or member-only areas - interfere with, disrupt, overload, or damage the Site, servers, networks, or services connected to the Site - attempt to reverse engineer, decompile, disassemble, or derive source code from any software or system used by the Site - copy or adapt the Site’s code, design, simulation structure, dashboard systems, or generated content for a competing or commercial purpose - impersonate another person or entity - submit false, misleading, infringing, abusive, defamatory, obscene, harassing, hateful, or unlawful material - upload or transmit malware, spyware, viruses, or harmful code - collect email addresses, usernames, access information, or other data from other users - use the Site or its content to harass, abuse, defame, threaten, or harm another person - use the Site in a way that violates any applicable law or regulation Violation of these rules may result in suspension, termination of access, deletion of content, blocking of IP addresses, or other action we consider appropriate. 8. GENERATED CONTENT AND FICTIONAL CONTENT The Site may include content generated, assisted, transformed, summarized, or organized using simulation systems, software tools, artificial intelligence, editorial tools, or automated processes. Generated or simulation-derived content may contain errors, inconsistencies, omissions, continuity issues, incomplete information, formatting problems, or experimental material. We may edit, revise, remove, regenerate, reorganize, or correct content at any time. The Site is provided for entertainment, creative, and development purposes. It should not be relied on as factual, professional, legal, medical, financial, safety, engineering, scientific, or operational advice. Some generated or AI-assisted content may be created, summarized, edited, or organized using third-party AI or language model providers. Such content may be imperfect, incomplete, inconsistent, or incorrect, and should be treated as fictional entertainment and prototype material. 9. THIRD-PARTY WEBSITES AND SERVICES The Site may link to third-party websites or services, including Patreon, analytics providers, hosting services, social platforms, payment processors, or other external services. We do not control third-party websites or services and are not responsible for their content, policies, availability, security, pricing, billing, or practices. Your use of third-party websites or services is at your own risk and is governed by their own terms and privacy policies. 10. SITE MANAGEMENT We reserve the right, but not the obligation, to: - monitor the Site for violations of these Terms - restrict, suspend, or terminate access to the Site - remove, edit, disable, or limit content - block users, accounts, IP addresses, or access credentials - correct errors, inaccuracies, or omissions - change, pause, or discontinue any part of the Site - manage the Site in a way that protects the project, users, systems, intellectual property, and service availability 11. PRIVACY POLICY Your use of the Site is also governed by our Privacy Policy, available at: https://isshorizon.com/privacy The Privacy Policy explains how we may collect, use, and share information, including information collected through Google Analytics, server logs, cookies, third-party services, and any forms or accounts that may be added to the Site. 12. COPYRIGHT AND TAKEDOWN REQUESTS We respect intellectual property rights. If you believe material on the Site infringes your copyright or other rights, please contact us with enough information to identify the material and explain your claim. Please note that false or misleading infringement claims may create legal liability. 13. TERMINATION These Terms remain in effect while you use the Site. We may deny, suspend, limit, or terminate your access to the Site at any time, with or without notice, if we believe you violated these Terms, created risk for the project or other users, attempted unauthorized access, misused content, or used the Site unlawfully. You may stop using the Site at any time. Sections relating to intellectual property, Submissions, disclaimers, limitation of liability, indemnification, third-party services, and general terms will survive termination. 14. MODIFICATIONS, INTERRUPTIONS, AND AVAILABILITY We may change, modify, suspend, interrupt, remove, or discontinue any part of the Site at any time, with or without notice. We do not guarantee that the Site will always be available, secure, error-free, uninterrupted, or compatible with every device or browser. The Site may experience downtime, errors, maintenance, outages, bugs, data issues, broken links, incomplete content, or other problems. We are not liable for any loss, damage, inconvenience, or interruption caused by your inability to access or use the Site. 15. CORRECTIONS The Site may contain typographical errors, inaccuracies, continuity errors, outdated information, broken links, pricing errors, feature descriptions that change, or other omissions. We reserve the right to correct, update, remove, or revise any content at any time without prior notice. 16. DISCLAIMER THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, SECURITY, AVAILABILITY, AND ERROR-FREE OPERATION. WE DO NOT GUARANTEE THAT: - THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE - GENERATED CONTENT WILL BE ACCURATE, COMPLETE, CONSISTENT, OR FREE OF ERRORS - THE SIMULATION WILL RUN CONTINUOUSLY - EPISODES, LOGS, ARCS, OR UPDATES WILL BE RELEASED ON A FIXED SCHEDULE - SUPPORTER BENEFITS WILL REMAIN UNCHANGED - ANY FEATURE, ROADMAP ITEM, OR PLANNED SYSTEM WILL BE COMPLETED - THE SITE WILL BE FREE FROM BUGS, SECURITY ISSUES, OR DATA LOSS YOUR USE OF THE SITE IS AT YOUR OWN RISK. 17. LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW, ISS HORIZON / COMMANDNET AND ITS OWNERS, OPERATORS, CONTRIBUTORS, CONTRACTORS, OR AFFILIATES WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOSS OF ACCESS, BUSINESS INTERRUPTION, REPUTATIONAL HARM, OR DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL BE LIMITED TO THE GREATER OF: - THE AMOUNT YOU PAID DIRECTLY TO US, IF ANY, IN THE SIX MONTHS BEFORE THE CLAIM AROSE; OR - $100. Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. 18. INDEMNIFICATION You agree to defend, indemnify, and hold harmless ISS Horizon / CommandNet and its owners, operators, contributors, contractors, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to: - your use of the Site - your violation of these Terms - your Submissions - your violation of another person’s rights - your unlawful conduct - your misuse of Site content, access credentials, or systems 19. USER DATA We may maintain certain data related to your use of the Site, such as analytics data, server logs, access records, support messages, or account-related information if accounts are enabled. Although we may perform backups or take reasonable steps to protect data, we do not guarantee that any data, access record, story content, account information, or user-submitted material will always be preserved or recoverable. You are responsible for keeping your own copies of any material you submit that is important to you. 20. ELECTRONIC COMMUNICATIONS Visiting the Site, clicking links, sending emails, submitting forms, joining Patreon, or otherwise communicating with us electronically constitutes electronic communication. You consent to receive electronic communications from us where applicable, including notices, updates, policies, and responses. You agree that electronic communications satisfy any legal requirement that such communications be in writing. 21. GOVERNING LAW These Terms and your use of the Site will be governed by the laws of the State of California, without regard to conflict-of-law principles, unless another jurisdiction is required by applicable law. If you prefer a different state for governing law, replace “California” with your state before publishing. 22. DISPUTE RESOLUTION Before bringing a formal claim, you agree to first contact us and try to resolve the dispute informally. If a dispute cannot be resolved informally, any claim arising out of or relating to the Site or these Terms will be handled in the state or federal courts located in California, unless applicable law requires otherwise. You and we agree that any dispute will be brought only on an individual basis and not as part of a class, collective, consolidated, or representative action, to the fullest extent permitted by law. 23. MISCELLANEOUS These Terms, together with any policies linked from the Site, represent the entire agreement between you and us regarding the Site. Our failure to enforce any right or provision of these Terms does not waive that right or provision. If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in effect. We may assign or transfer our rights and obligations under these Terms. You may not assign your rights or obligations without our written permission. No joint venture, partnership, employment, fiduciary, or agency relationship is created between you and us by these Terms or your use of the Site. 24.
